Overview (Program Summary)
The Respect@Work laws have been passed by the Federal Parliament at a time when the prevailing attitudes in the Australian community are that misconduct of this nature should not be tolerated. We have seen increased financial liability for sexual harassment (and related misconduct).
Society more generally and the Courts have expressed frustration with workplace incidents that are poorly managed and result in sexual harassment, sex discrimination, sex-based harassment occurring in the workplace, which often has significantly detrimental impacts on the lives of those involved.
Our team will cover:
- The new features of the enhanced and expanded laws (and their impact)
- What should be done to get your organisation ready
- An understanding of how to build a culture where your business and employees are protected against sexual harassment, sex based discrimination and harassment
- How to swiftly and appropriately deal with this behaviour if it ever arises and protect against claims
This session will be relevant for in-house counsel roles, human resources managers and anyone involved in workplace management.
Joe is an employment relations lawyer with over 20 years’ experience specialising in workplace relations at mid-tier and employer associations.
Joe’s experience extends to providing advice and representation in matters across Australian tribunals and courts, including the Fair Work Commission and the Federal Courts of Australia. Joe has also represented clients in various inquests and commissions of inquiry, including in the Independent Commission Against Corruption and various State Coroner’s Inquests and Inquiries.
Regular matters in which clients require Joe’s expertise, include redundancies, unfair dismissals, general protections (adverse action) claims, executive and complex dismissals and separations, discrimination claims, industrial disputes, managing long and short term injured workers, troublesome workers compensation claims, employee fraud, employee privacy and surveillance, investigations (including in connection with whistleblower complaints), and the defence of underpayment claims brought by employees, unions and the Fair Work Ombudsman.
Joe has extensive experience assisting clients with disputation between employers and their employees (whether dealing with employees collectively or individually).
Emily Slaytor, Special Counsel
Emily joined Piper Alderman as a Special Counsel in 2021, after having relocated to Adelaide from Sydney where she worked for a specialist employment law firm.
She has around 10 years’ experience practicing as an employment and industrial relations lawyer, assisting and advising employers on how to manage their legal obligations and risks, and navigate employment-related issues.
Emily has acted for a diverse range of employers across both the private and public sector, at a national level. She has conducted numerous investigations for clients in relation to bullying and harassment matters and internal employment disputes, and regularly assists clients in the areas of managing long and short term injured workers, difficult workers compensation claims, performance management and disciplinary issues, discrimination and harassment, as well as unfair dismissal and general protections claims.
